INTERIM — PENDING LEGAL REVIEW. These are interim terms for the JAWN beta, written in plain language and provided in good faith. A full, lawyer-reviewed Terms of Service will replace them. This is not legal advice.

Overview

These terms govern your use of the JAWN application at jawn.chalkedai.com, operated by Chalked Performance Intelligence LLC ("Chalked", "we", "us"). By creating an account or using JAWN, you agree to these interim terms.

Eligibility

You must be at least 13 years old to use JAWN. When you create an account, you confirm that you are 13 or older. JAWN is not intended for children under 13.

Your account

You are responsible for keeping your login credentials secure and for activity under your account. Provide accurate information when you sign up, and let us know at support@chalkedai.com if you believe your account has been compromised.

The beta

JAWN is in beta. That means the service is evolving, may change or be interrupted, and may contain errors. Features can be added, changed, or removed, and the beta may end. We provide the service on an "as-is" and "as-available" basis during this period.

Your content and your recordings

You own your recordings and the content you create. By using JAWN, you grant us the permission needed to process your recordings and content in order to provide the service to you, for example, to transcribe, analyze, generate your results, and store them for your access. This permission exists so we can run the product for you; it does not transfer ownership of your content to us. We describe how your data is handled, and who helps process it, in our Privacy Policy.

Acceptable use

Use JAWN for its intended purpose: practicing and improving your own communication. Do not use it to upload content you do not have the right to record or share, to record other people without their knowledge or consent where consent is required, to break the law, to infringe others' rights, to attempt to disrupt or reverse-engineer the service, or to misuse or overload it.

The analysis is guidance, not a verdict

JAWN's scores and feedback are generated by automated and AI systems and are intended as practice and coaching guidance. They are estimates, not professional, legal, medical, or clinical advice, and they may not always be accurate. You are responsible for how you use the feedback. Outcomes in real-world communication moments depend on many factors beyond JAWN.

Our intellectual property

JAWN, the Chalked and JAWN brands, and the application, including its design, the analysis system, and all underlying technology and methods, are owned by Chalked Performance Intelligence LLC and are protected by intellectual-property laws. These terms do not give you any rights in them beyond using the service as intended.

Disclaimers and limitation of liability

The service is provided "as is" without warranties of any kind, to the fullest extent permitted by law. To the fullest extent permitted by law, Chalked will not be liable for indirect, incidental, or consequential damages arising from your use of the beta. (Note: the enforceable scope of these provisions will be set in the full reviewed terms.)

Termination

You may stop using JAWN at any time and may request account deletion at support@chalkedai.com. We may suspend or end access for conduct that violates these terms or harms the service or other users.

Governing law

These terms are governed by the laws of the State of Florida, and any disputes will be handled in the courts located in Pinellas County, Florida, to the extent permitted by law.

Changes

These are interim terms and will be replaced by a complete, reviewed Terms of Service. When we make material changes, we will update the date above.
